1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and PermerCRM, Inc. governing your access to and use of the PermerCRM platform.
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2. Eligibility
You must meet the following requirements to use the Service:
- Be at least 18 years of age.
- Represent a legitimate business entity.
- Possess a valid WhatsApp Business Account.
- Comply with all WhatsApp/Meta Business policies.
3. AI Supervision
The Service utilizes advanced AI to automate interactions. You retain ultimate responsibility for your customer relationships, including monitoring AI interactions for quality assurance and promptly handling escalations. We are not liable for negative sentiment arising from your failure to provide necessary human oversight.
4. Payment & Settlement
Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law.
4.1 Merchant Settlement Window
To facilitate transaction verification, fraud prevention, and provide room for potential refund requests, we implement a Mandatory Maturity Window of 24 to 72 hours for all incoming merchant funds.
Funds will appear as "Pending" in your Wallet during this window and will transition to "Available" for payout once the maturity period has elapsed and the transaction is confirmed as legitimate.
5. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. However, if you are a user located in another jurisdiction, you may also benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.
6. Data Processing Commitment
We are committed to protecting the privacy and security of your data. Our processing activities are governed by our Privacy Policy and all applicable data protection laws, including the Nigeria Data Protection Regulation (NDPR) and other regional protocols where we operate. By using the Service, you acknowledge and agree to the data practices described in our Privacy Policy.
